Privacy policy

Health Synergy is a trading name of Invincible Living (Pty) Ltd ("we", "us"). This policy explains how we collect, use, share and protect your personal information when you visit healthsynergy.co.za, buy from us or contact us. We process personal information under the Protection of Personal Information Act 4 of 2013 (POPIA). If this policy and our Terms of service differ on personal information, this policy applies.

What we collect

Depending on how you use our website, we collect:

• Contact details: your name, email address, phone number, and billing and delivery addresses.
• Order details: what you buy, return or exchange, your order history and delivery details.
• Payment details: your payment method and payment confirmation. You enter card details with our payment providers; we never see or store your full card number.
• Account details: your login, preferences and saved items.
• Messages: what you tell us by email, phone, chat or social media.
• Reviews: product reviews you choose to post, with the name you give.
• Device and usage details: your IP address, browser and device type, the pages you view and how you use the site. We collect these with cookies and similar tools.

Where we get it

• From you, when you order, create an account, sign up for our newsletter, post a review or contact us.
• Automatically, through cookies and similar tools when you use our website.
• From our service providers, for example payment confirmations and courier delivery updates.

Who we share it with

We share personal information only as this policy describes, with:

• Shopify, the platform that hosts our store, checkout and customer chat.
• Payment providers: Stitch, Payfast, PayJustNow and Payflex.
• Our courier partners, to deliver your order.
• Seguno and Omnisend, which send our marketing emails to people who have signed up.
• Judge.me, for product reviews.
• Google, for advertising (Google Ads), website analytics (Google Analytics) and product listings (Google Merchant Center).
• Wishlist Hero, which saves your wishlist.
• Our back-in-stock app, which tells you when a product you asked about is back in stock.
• Blockify, which protects our store against fraud and blocks suspicious visitors.
• Facebook & Instagram and TikTok, social-media shopping channels where our products are listed. They may receive information when you shop through them or interact with our ads there.
• Professional advisers, such as our accountants, auditors and lawyers.
• Authorities, such as SARS or the police, when the law requires it.
• A buyer of our business, if we sell or restructure it. They must protect your information as this policy describes.

Service providers that process information for us must keep it confidential and secure, and may use it only to provide their services to us.

Our store runs on Shopify

Shopify processes personal information to provide and improve its services. To learn how Shopify uses personal information, see the Shopify Consumer Privacy Policy. You can also use certain rights directly through the Shopify Privacy Portal.

Links to other websites

Our website links to other websites and social networks. They have their own privacy practices, so read their policies before you share information with them. Anything you post publicly, such as a review or a social media comment, can be seen by others.

Children

Our website is for adults. We don't knowingly collect personal information from anyone under 18. If you're a parent or guardian and think your child has given us their information, email info@healthsynergy.co.za and we'll delete it.

Security

We protect personal information with reasonable technical and organisational measures, including encrypted connections and access limited to people who need it. No system is completely secure, so please don't send card details or other sensitive information by email or chat. If a security breach puts your personal information at risk, we'll tell you and the Information Regulator, as POPIA requires.

This section sets out what POPIA requires us to tell you.

Why we use your information, and our legal basis

POPIA lets us process personal information only with a lawful basis (section 11). Ours are:

• Process, deliver and support your order, including returns and refunds. Information used: contact, order and payment details. Legal basis: needed to perform our contract with you.
• Run your customer account. Information used: account and contact details. Legal basis: needed to perform our contract with you.
• Answer your questions. Information used: messages, contact and order details. Legal basis: our contract with you, or our legitimate interest in helping you.
• Keep tax and accounting records. Information used: order and payment details. Legal basis: required by law.
• Prevent fraud and keep the website secure. Information used: device, usage, order and payment details. Legal basis: our legitimate interest in protecting customers and our business.
• Send newsletters and offers. Information used: name and email address. Legal basis: your consent, which you can withdraw at any time.
• Measure and improve our website and ads, and show our ads. Information used: device and usage details. Legal basis: our legitimate interest in running our store, and your cookie choices.
• Publish your product review. Information used: your review and display name. Legal basis: your consent.

You don't have to give us personal information. But we need your name, contact details, delivery address and payment to fulfil an order, and we can't process it without them. Where we rely on our legitimate interests, you can object at any time (see Your rights).

Health information you choose to share

We don't ask for health information. If you tell us about your health, for example when asking about a product, we use it only to answer you and never for marketing. By sending it, you consent to that use. Health information is special personal information under POPIA, so please share only what we need, and ask us to delete it at any time.

Direct marketing

We send marketing emails only to people who have signed up, for example through our newsletter form or the marketing box at checkout. Every message says who it's from and gives you a free way to unsubscribe. You can also unsubscribe by emailing info@healthsynergy.co.za. We keep a record that you unsubscribed so we don't contact you again.

Sending information outside South Africa

Some of our service providers store or process personal information outside South Africa, for example in the United States and Canada. They include Shopify, which hosts our store, and providers such as Google, Judge.me, Seguno, Omnisend, Facebook & Instagram and TikTok. We send personal information abroad only as POPIA section 72 allows: where the recipient is bound by law or a binding agreement that gives protection substantially similar to POPIA, or where the transfer is needed to perform our contract with you.

How long we keep it

• Orders, invoices, payments, returns, tax and accounting records: 7 years, as the Companies Act requires.
• Account profile: until you close your account or ask us to delete it.
• Emails, chats and other messages: 2 years after your last message.
• Marketing data: until you unsubscribe; then only a record that you opted out.
• Product reviews: until you ask us to remove them.
• Cookies: each cookie's own expiry, up to 2 years.

When we no longer need information, we delete it or make it anonymous.

Cookies

Cookies are small files stored on your device. We and our service providers use them to:

• Make the site work: your cart, checkout, login and security. The site can't work properly without these.
• Measure and improve the site: Shopify and Google Analytics show us how visitors use it.
• Advertise: Google, Facebook & Instagram and TikTok measure our ads and may show them to people who have visited our site.

Where our cookie banner appears, use it to accept or decline analytics and advertising cookies. You can also block or delete cookies in your browser settings at any time. If you block the cookies that make the site work, the cart and checkout won't work. Shopify explains its own cookies in its cookie policy.

Your rights

Under POPIA you have the right to:

• access the personal information we hold about you, and get a copy;
• correct or delete information that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or unlawfully obtained;
• object, on reasonable grounds, to processing based on our legitimate interests;
• object to direct marketing at any time, free of charge;
• withdraw your consent at any time, without affecting processing already done;
• be told if someone has accessed your information without authority;
• not be subject to a decision based solely on automated processing that has legal consequences for you;
• complain to the Information Regulator, and take legal action.

To use these rights, email info@healthsynergy.co.za with "Privacy request" in the subject line. We may ask you to confirm your identity first, and we'll reply within 30 days. Someone else can make a request for you if they send us your written permission. We may have to keep some information, such as tax records, even after you ask us to delete it.

Complaints and the Information Regulator

If you're unhappy with how we've handled your personal information, contact our Information Officer first so we can try to put it right. You can also complain to the Information Regulator at any time:

Changes to this policy

We may update this policy. We'll post the new version on this page and change the date at the top. If a change materially affects how we use your information, we'll also tell you by email or on our website.
